Welcome to Alpha Side Branding Company ("Alpha Side Branding," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, online store, products, and services.

By accessing our website, requesting a quote, approving artwork, placing an order, or submitting payment, you agree to be bound by these Terms of Service. If you do not agree with these Terms, please do not use our website or services.

Eligibility

By using our website or placing an order, you represent that you are at least 18 years of age or have the legal authority to enter into a binding agreement.

Alpha Side Branding Company provides custom branding and promotional solutions, including but not limited to:

  • Custom Apparel

  • Embroidery

  • Screen Printing

  • Direct-to-Film (DTF) Printing

  • UV Printing

  • Laser Engraving

  • Promotional Products

  • Signs & Banners

  • Awards & Plaques

  • Stickers & Decals

  • Team & Fundraising Webstores

  • Graphic Design Services

All products are subject to availability.

Pricing

Prices are subject to change without notice.

Quotes are generally valid for 30 days unless otherwise specified.

We reserve the right to correct pricing errors, typographical errors, or product description inaccuracies before accepting or fulfilling an order.

Payment

Payment is required before production begins unless alternative payment terms have been approved in writing.

Orders will not enter production until payment requirements have been satisfied.

Returned payments, declined transactions, chargebacks, or payment disputes may result in delays or cancellation of an order.

Artwork Approval

Customers are responsible for reviewing all artwork proofs before approval.

Approval confirms acceptance of:

  • Artwork

  • Product selection

  • Colors

  • Spelling

  • Layout

  • Placement

  • Quantities

  • Sizes

Once artwork has been approved, Alpha Side Branding Company is not responsible for customer-approved errors.

Additional artwork revisions after approval may result in additional charges.

Intellectual Property

Customers represent and warrant that they own or have permission to reproduce all submitted artwork, logos, trademarks, names, and copyrighted materials.

Customers agree to indemnify and hold harmless Alpha Side Branding Company from any claims arising from unauthorized use of submitted artwork.

Unless otherwise agreed in writing, all custom artwork, graphic designs, mockups, embroidery digitizing files, production files, layouts, and design concepts created by Alpha Side Branding Company remain the property of Alpha Side Branding Company.

Production Variations

Custom decoration involves manufacturing processes that naturally produce slight variations.

Minor differences in:

  • Thread colors

  • Ink colors

  • Garment dye lots

  • Print placement

  • Embroidery placement

  • Product dimensions

  • Product finishes

are considered normal industry tolerances and do not constitute defects.

Customer-Supplied Garments

Customer-supplied garments are subject to our Customer-Supplied Garment Policy.

Customers acknowledge that embroidery and decoration involve mechanical production processes that carry inherent risks.

When Alpha Side Branding Company supplies the garment, production-related garment damage is covered by us.

Customer-owned garments are decorated at the customer's risk in accordance with our Customer-Supplied Garment Policy.

Shipping

Shipping is governed by our Shipping Policy.

Production time and shipping transit time are separate estimates.

Alpha Side Branding Company is not responsible for delays caused by shipping carriers, manufacturers, weather, supply chain disruptions, customs processing, or events beyond our reasonable control.

Returns & Refunds

Because most products are custom manufactured or personalized, they are generally non-returnable and non-refundable.

If a production error or manufacturing defect caused by Alpha Side Branding Company is verified, we will repair, replace, or otherwise resolve the issue at our discretion.

Any concerns regarding shortages, defects, or incorrect items must be reported within seven (7) calendar days of delivery or pickup.

Promotional Products

Many promotional products are manufactured by third-party suppliers.

Colors, finishes, dimensions, and availability may vary slightly from published images.

Equivalent product substitutions may occasionally be necessary due to manufacturer inventory.

Team Stores & Fundraising Programs

Organizations participating in fundraising or online webstore programs agree to the terms established for their specific program.

Profit-sharing payments are calculated according to the agreed program after applicable production costs, payment processing fees, taxes (where applicable), refunds, and other agreed expenses have been deducted.

Website Use

You agree not to:

  • Use the website for unlawful purposes.

  • Attempt unauthorized access to our systems.

  • Upload malicious software.

  • Copy website content without written permission.

  • Misrepresent your identity.

  • Interfere with website functionality.

We reserve the right to refuse service or terminate website access for violations of these Terms.

Limitation of Liability

To the fullest extent permitted by applicable law, Alpha Side Branding Company's total liability arising from any order or service shall not exceed the amount paid for the specific product or service giving rise to the claim.

Alpha Side Branding Company shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost business opportunities, or business interruption, except where prohibited by applicable law.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by law.

Force Majeure

Alpha Side Branding Company shall not be responsible for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to:

  • Severe weather

  • Natural disasters

  • Fire

  • Flood

  • Government actions

  • Labor shortages

  • Supply chain interruptions

  • Equipment failures

  • Utility outages

  • Shipping carrier delays

  • Acts of God

Indemnification

You agree to defend, indemnify, and hold harmless Alpha Side Branding Company, its owners, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your submitted artwork

  • Violation of these Terms

  • Misuse of our products or services

  • Intellectual property disputes

Privacy

Your use of our website is also governed by our Privacy Policy.

Governing Law

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania.

Any legal action arising from these Terms shall be brought in a court of competent jurisdiction located within the Commonwealth of Pennsylvania, unless otherwise required by applicable law.

Changes to These Terms

Alpha Side Branding Company reserves the right to update or modify these Terms of Service at any time.

Revised Terms become effective upon publication on our website.

Continued use of our website or services constitutes acceptance of the revised Terms.
